The Home Department issued an order today giving compulsory retirement to RPS Shri Kailashchand Bohra, accused of serious misconduct. Under Rule 53 (1) of Rajasthan Pension Rules 1996, there is a provision for giving compulsory retirement in the public interest to the state personnel who have completed 15 years of service or have completed 50 years of age. In this provision Mr. Bohra has been given immediate compulsory retirement.
It is worth mentioning that in Article 311 of the Constitution, it is necessary to give every state employee an opportunity to be heard before he is separated from the service. In view of this issue of Mr. Bohra as a whole, compulsory retirement has been given keeping the proceedings of CCA Rule 19 under consideration. After compulsory retirement, action will be taken under the rules by issuing proceedings in the CCA Rules. Since Mr. Bohra has completed 24 years and 7 months of service and has also completed 52 years of age. Therefore, dismissal proceedings will commence after compulsory retirement under such circumstances.
