The Election Commission of India (ECI) has mandated the enforcement of ‘dry days’ in poll-bound states ahead of the 2026 Assembly elections and by-elections, in line with legal provisions under the Representation of the People Act, 1951.
Key Details:
- Assembly elections will be held in Tamil Nadu, West Bengal, Assam, Kerala and Puducherry.
- Voting in Tamil Nadu and Phase-1 of West Bengal will take place on April 23, 2026, while Phase-2 polling in West Bengal is scheduled for April 29, 2026.
- Counting of votes for all states and bypolls will be conducted on May 4, 2026.
Dry Day Guidelines:
- As per Section 135C of the Representation of the People Act, a 48-hour ‘dry period’ will be enforced before the close of polling in each constituency.
- During this period, sale, distribution, or serving of liquor is strictly prohibited at hotels, restaurants, clubs, shops, or any public/private place.
- The restriction will also apply on counting day (May 4, 2026), which will be declared a dry day.
- The rules extend to star hotels, clubs, and establishments with liquor licenses—no exemptions will be allowed.
Enforcement Measures:
Authorities have been directed to strictly monitor and restrict storage and illegal distribution of alcohol during this period. Excise laws will be rigorously enforced to prevent violations.
